Terms of Service

These Terms of Service govern your use of skyreach.io and your engagement with Skyreach LLC (“Skyreach,” “we,” “us”). By booking a discovery call, signing a proposal, or making a payment, you agree to these terms in full.
Please read these terms before engaging with us. If any part is unclear, email us at admin@skyreach.io before proceeding.
1. Services
Skyreach builds complete working business systems for US local service businesses. Services may include websites, booking systems, SMS follow-up sequences, payment flows, and operational dashboards, depending on your selected tier.
The specific deliverables for your engagement are defined in a written scope document (“the brief” or “fit memo”) that you and Skyreach agree to before work begins. That document, once signed or acknowledged, is the binding specification. If there is a conflict between these terms and the scope document, the scope document governs the specific deliverable in question.
2. Engagements and Payment
No work begins without a cleared deposit. This is a hard rule, not subject to exception.
- Productized tier ($3,000–$5,000): 50% deposit required before work begins. Remaining balance due upon delivery of the working system.
- Mid tier ($8,000–$15,000 + monthly retainer): 50% deposit required before work begins. Remaining project balance due at launch. Retainer billed monthly starting at launch.
- Custom tier ($20,000+): Payment structure defined in the project agreement.
All payments are processed via Stripe. Invoices are issued in US dollars. Payments are non-refundable once work on the agreed scope has begun, except where Skyreach fails to deliver the written scope.
Post-launch fixes: If a delivered system does not function as specified in the written scope within 7 days of launch, we will correct it at no additional charge. Issues outside the written scope are billed separately.
3. SMS Program Terms
Skyreach uses text messaging to communicate with clients and prospects. The following applies to all SMS communications from Skyreach LLC:
- Program name: Skyreach SMS
- Sender: Skyreach LLC, +1-571-946-5980
- Message types: Booking confirmations, appointment reminders, project updates, and follow-ups after a discovery call you initiated.
- Frequency: Up to 4 messages per month, depending on your project stage. We do not send promotional blasts.
- Opt out: Reply STOP at any time. You will receive one confirmation and no further messages. Opting out does not affect your active engagement — we will use email for project communication instead.
- Help: Reply HELP or email admin@skyreach.io.
- Message and data rates may apply based on your wireless carrier plan.
By providing your phone number and texting us, you consent to receive SMS from Skyreach LLC under these terms and our Privacy Policy. We do not sell or share your phone number with third parties for marketing.
4. Client Responsibilities
You agree to:
- Provide accurate information during intake and onboarding.
- Respond to questions or review requests within 3 business days to keep the project on schedule. Delays caused by non-response may extend the delivery timeline.
- Provide access to existing accounts (hosting, domain, booking platforms) as needed. We never create accounts in our own name — all accounts remain in yours.
- Not use the delivered system to violate any law, including TCPA, CAN-SPAM, or applicable consumer protection regulations.
5. Intellectual Property
Upon receipt of final payment, you own all custom code, copy, and design produced for your specific engagement. Skyreach retains the right to use generic frameworks, templates, and tools in other projects.
Skyreach retains ownership of any internal tools, workflows, or systems used to build your deliverable that are not part of the agreed scope. You receive the output; not necessarily the internal production tools.
6. Confidentiality
Both parties agree to keep non-public business information shared during the engagement confidential. This includes pricing, client lists, internal processes, and project details not publicly disclosed.
Skyreach will not publicly reference your business as a client without your written permission (email is sufficient). You may choose to provide a testimonial at your discretion.
7. Limitation of Liability
Skyreach's total liability to you for any claim arising from our services is limited to the amount you paid Skyreach in the 3 months preceding the claim. Skyreach is not liable for indirect, consequential, or incidental damages, including lost revenue or lost business opportunities.
This limitation applies to the fullest extent permitted by law. Some jurisdictions do not allow certain liability exclusions; in those cases, our liability is limited to the maximum extent permitted.
8. Acceptable Use
Skyreach does not accept engagements in the following categories (SHAFT): supplements, hemp/cannabis, alcohol, firearms, tobacco/vaping, or any business whose primary purpose conflicts with applicable law. Misrepresenting your business category to circumvent this policy is grounds for immediate termination of the engagement with no refund of paid amounts.
We also do not build systems designed to deceive consumers, generate fake reviews, or gate legitimate customer feedback (NPS review gating). Any system built must comply with FTC endorsement guidelines and applicable consumer protection law.
9. Termination
Either party may terminate an active engagement by providing written notice (email is sufficient). Upon termination:
- Work completed through the termination date is billable at the rate implied by the project scope.
- All accounts, credentials, and deliverables completed to date transfer to the client immediately.
- Deposits are non-refundable once work has begun on the agreed scope.
10. Governing Law
These Terms are governed by the laws of the Commonwealth of Virginia, without regard to its conflict of law provisions. Any dispute that cannot be resolved by good-faith discussion will be submitted to binding arbitration in Northern Virginia under the rules of the American Arbitration Association.
11. Changes to These Terms
We may update these terms from time to time. For active engagements, the version in effect at the time the scope was agreed upon governs the engagement unless both parties agree in writing to apply a newer version. For general site use, the current version applies.
